SM Entertainment And EXO-CBX’s Legal Feud Moves Forward In Court Ahead Of Group Comeback

The ongoing legal battle between SM Entertainment and EXO’s subunit CBX (Baekhyun, Xiumin, and Chen) is set to take its next step in court. A mediation session has officially been scheduled, just as the group prepares for their long-awaited return.

On September 22, reports revealed that the Seoul Eastern District Court’s 15th Civil Division has referred SM’s lawsuit against Chen, Baekhyun, and Xiumin — along with the unit’s countersuit — to mediation. The case involves a disputed amount of roughly ₩600 million KRW (about $429,000 USD).

The first session will take place on September 23 at 2:45 PM KST.

SM Entertainment initially filed the suit in June 2023, insisting that the members’ exclusive contracts were still valid. At the time, the company also criticized CBX’s actions as “unacceptable.”

In response, CBX countersued, claiming they were not properly given settlement statements. Through their new agency INB100, the members argued that SM failed to honor the 5.5 percent distribution fee for albums and digital sales. They also described the requirement to hand over 10 percent of their personal revenue as unfair.
