Actor Kim Soo Hyun‘s side has warned that they will take further actions in relation to the actor’s controversy with the late Kim Sae Ron.
Kim Soo Hyun’s legal representative, lawyer Ko Sang Rok, appeared on YTN Radio’s Wise Radio Life on the 1st and emphasized, “While criminal punishment is important, it is equally crucial to receive strict legal judgment through claims for civil damages,” foreshadowing civil action against Garosero Institute‘s Kim Se Ui.
Lawyer Ko particularly stated, “To prevent such cybercrimes from recurring, civil liability must also be clearly enforced,” adding, “There must be strong responsibility to the extent of destroying the economic foundation to ensure that the same acts cannot be repeated even after release.”
He continued, “If a large amount of damages is recognized, it will be difficult for Mr. Kim to bear it solely with his personal assets,” explaining, “If he cannot fully repay the compensation, he may face long-term indebtedness.”
Lawyer Ko also made it clear that Kim Se Ui cannot evade legal responsibility through personal rehabilitation or bankruptcy procedures.
He pointed out, “Damages arising from malicious unlawful acts have a different nature from general debts,” adding, “Even if bankruptcy or rehabilitation proceedings are conducted, they will not be discharged or reduced.”
In fact, the current Debtor Rehabilitation Act defines damages claims arising from intentional unlawful acts as ‘non-dischargeable claims,’ so even if the court acknowledges the damages liabilities and bankruptcy is declared, the debt itself does not disappear.
Previously, Kim Se Ui was under investigation on charges of repeatedly spreading various falsehoods that could damage Kim Soo Hyun’s reputation through broadcasts of the Garosero Institute related to the late Kim Sae Ron and others. Considering the seriousness of the matter, the investigative authorities requested an arrest warrant for Kim, which the court recently granted.
Meanwhile, the detention review hearing requested by the detained Kim Se Ui is scheduled to take place on the 2nd at the Seoul Central District Court. Separately from this criminal procedure, Kim Soo Hyun’s side is actively considering a strong civil lawsuit, including a large-scale damages claim, maintaining a tough stance.
