Lawyer Classifies Top Actress’s Newborn Child To Be Born Out Of Wedlock
Amid the controversy surrounding actress Lee Si Young giving birth through embryo transfer without her ex-husband’s consent, a practicing lawyer provided an analysis regarding the legal issues.

On November 17, attorney Lee Jeongmin appeared on YTN radio and discussed the issue of Lee Si Young’s childbirth controversy.
The possibility of criminal punishment appears low because the consent of the parties is only required during the embryo creation stage, and there are no consent provisions for the transplantation stage.
They added that because there was no legal requirement to obtain separate consent for the transplant stage, they found it difficult to see it as a procedural flaw.
Also, her ex-husband’s statement that he would “fulfill his responsibilities as a father” makes it difficult to view it as a withdrawal of consent.

The lawyer stated that in terms of legal status, her second child would be classified as “born out of wedlock” and that until her ex-husband acknowledges themselves as the biological father, they are legally treated as a stranger.
Regarding the issue of child support, the court stated, “Until the father is recognized as the biological father, the parent-child relationship is not presumed; therefore, no legal responsibility is taken.”
Regarding inheritance rights, because Lee Si Young is not the spouse of the ex-husband, she has no inheritance rights. However, if he is recognized as the biological father, the priority for inheritance applies to the child.
