Amid a series of controversies surrounding Park Na Rae, including wage arrears, embezzlement, and drug allegations, a legal expert’s analysis has sparked significant public reaction by stating that even first-time drug offenses could lead to prison sentences.
Attorney Jang Hyun Oh of SK Law Office analyzed the legal issues related to Park Na Rae’s allegations by categorizing them individually on his YouTube channel.
He explained by assigning scores to the likelihood of criminal charges, stating that a score of 80 or above falls within the range that could result in a prison sentence.
Regarding the wage arrears controversy, Attorney Jang described it as “a clear crime that could lead to criminal punishment if labor inspectors intervene,” rating it about 50 points.
On the suspicion of embezzlement in the course of work, he said, “It depends on the amount, but it can be seen as around 70 points,” adding, “Although imprisonment cases are rare, it is definitely a crime.”
The highest severity was attributed to the so-called “injection auntie” drug-related allegations.
Attorney Jang stated, “Being a first offender does not automatically mean probation will be granted,” emphasizing, “Whether the score is 80 plus or minus one point depends ultimately on how Park Na Rae responds.”
This suggests that even for first-time drug offenses, a prison term is possible.
As for the possibility of charges related to specialized injury, he considered the presence or absence of a settlement as a key variable, evaluating it at 75 points. “If a settlement is reached, it’s somewhat better, but if not, the risk increases,” he said.
Conversely, some controversies surrounding behavior inside a vehicle were deemed less likely to be considered criminal, with approximately 30 points assigned—equivalent to a fine level—stating, “Most behaviors known as sexual harassment are difficult to classify as crimes.”
However, he added that the level of punishment could change if specific actions are confirmed.
Attorney Jang noted that if multiple charges apply simultaneously, sentencing will be calculated under the principle of concurrent sentencing, adding, “As a result, the possibility of incarceration cannot be ruled out.”
Finally, he offered practical advice to Park Na Rae’s side. “Looking at the situation over the past month, opportunities for settlement or reconciliation are growing increasingly distant, with additional exposures intensifying the conflict,” he said, warning, “Considering the risk of actual prison time, this is not a good direction at all. For her own future, she should settle what can be settled and consult thoroughly with her lawyer to avoid the worst outcome.”
